The U.S. Citizenship and Immigration Services (USCIS) have identified 39 countries who can participate in the H-2A and H-2B non-immigrant visa programs in the year 2010. This decision was made based on the regulation set by the Department of Homeland Security following the notice published in the Federal Register by the Secretary of Homeland Security.
The notice published in the Federal Register by the Secretary of Homeland Security along with the Secretary of State has stated that, the nationals of the 39 countries can apply for H-2A and H-2B non-immigrant status in the time period from January 18, 2010 until the end of one year after January 18, 2010.
The 28 countries out of the 39 countries were designated in December 18 and 19, 2008 notices and still remain eligible to participate in H-2A and H-2B visa programs as they continue to meet the standards set in the notices issued earlier. The 28 countries originally included are Argentina, Australia, Belize, Brazil, Bulgaria, Canada, Chile, Costa Rica, Dominican Republic, El Salvador, Guatemala, Honduras, Indonesia, Israel, Jamaica, Japan, Mexico, Moldova, New Zealand, Peru, Philippines, Poland, Romania, South Africa, South Korea, Turkey, Ukraine, and United Kingdom.
In a new development to the report, 11 additional countries are now termed eligible to participate in the H-2A and H-2B visa programs in the coming year. Only after taking into considerations certain important aspects, these 11 new countries were added to the list. The 11 new countries that can now participate in the H-2A and H-2B visa program for the first time are Croatia, Ecuador, Ethiopia, Ireland, Lithuania, The Netherlands, Nicaragua, Norway, Serbia, Slovakia, and Uruguay.
Individuals who already hold the H-2A and H-2B non-immigrant status need not worry about this notice. This notice is also renewed every year; hence USCIS will now approve petitions for nationals of the 39 listed countries for H-2A and H-2B nonimmigrant status.
